SCOMET vs EAR - India’s Export Controls Compared to US Commerce Department Rules

While our earlier article compared SCOMET to ITAR (the US defence export controls), many Indian exporters also need to understand the Export Administration Regulations (EAR) - the US system that controls dual-use items. Since SCOMET covers both dual-use and defence items in a single list, understanding how it maps to the EAR’s Commerce Control List is critical for exporters engaged in US trade.

What is the EAR?

The Export Administration Regulations (EAR), codified in 15 CFR Parts 730-774, govern the export and re-export of dual-use items from the United States. The EAR is administered by the Bureau of Industry and Security (BIS) under the US Department of Commerce.

The EAR’s control list - the Commerce Control List (CCL) - contains items classified by ECCN (Export Control Classification Number). Items subject to EAR but not on the CCL are classified as EAR99.

Critical Difference - The Country Matrix

The most significant practical difference is how licence requirements are determined. Under SCOMET, if your item is on the list, you generally need an authorisation regardless of the destination country (with limited exceptions for certain CWC chemicals to member states).

Under the EAR, the licence requirement depends on a matrix of the item’s ECCN, the reason for control, and the destination country group. An item with ECCN 3A001 might need a licence for export to Country Group D (certain restricted countries) but not for Country Group A (close allies). This makes the EAR system more granular but also more complex to navigate.

When Both Systems Apply to Indian Exporters

  • US-origin components - if your Indian product contains US-origin parts controlled under the EAR, re-exporting the finished product from India may require BIS authorisation in addition to any SCOMET requirements.
  • US-origin software and technology - using EAR-controlled software or technical data received from a US company remains subject to EAR restrictions even after the information reaches India.
  • Foreign Direct Product Rule - in certain cases, products made outside the US using US-origin technology or software may themselves be subject to EAR controls.

Practical Guidance

  • Always classify under SCOMET first - it is your primary obligation as an Indian exporter.
  • If your product contains US-origin content or uses US-origin technology, also check EAR requirements.
  • Maintain separate classification records for both SCOMET codes and ECCNs if you deal with US trade.
  • Do not assume that EAR99 status means the item is also not SCOMET-controlled - each list must be checked independently.
